GENERAL TERMS AND CONDITIONS OF SALE AND SERVICE PROVISION
ARTICLE 1 – Scope
These General Terms and Conditions of Sale and Service Provision (hereinafter referred to as the “General Conditions”) apply without restriction or reservation to all sales and services provided by CARIBBEAN ACADEMY SAS, Galerie de la rosière lot7, 97129 Le LAMENTIN, registered with the RCS of STRASBOURG under the number …, and operating under the name CARIBBEAN ACADEMY, to buyers (hereinafter referred to as the “Client”), who wish to purchase products (hereinafter referred to as the “Products”) or benefit from the services (hereinafter referred to as the “Services”) offered by CARIBBEAN ACADEMY, 67000 STRASBOURG. These Conditions specify, in particular, the terms of payment and management of the Products ordered by the Client, as well as the conditions for canceling Service orders.
The Client declares having read and accepted these General Conditions.
These General Conditions may be subject to subsequent modifications, with the applicable version being the one in effect on the date of the Client’s order.
By subscribing to a course or “camp” via the website and the booking site http://caribbean-academy.fr, the Client fully and entirely accepts these General Terms and Conditions of Sale, which is expressly recognized by the Client, who waives the right to invoke any contradictory document, which would be unenforceable against CARIBBEAN ACADEMY.
In accordance with the French Data Protection Act of January 6, 1978, the Client has the right to access, rectify, and oppose all of their personal data at any time by writing to or by email to contact@caribbean-academy.fr.
The validation of the order or payment by the Client constitutes acceptance without restriction or reservation of these General Terms and Conditions of Sale.
The Client acknowledges having the necessary capacity to contract and acquire the Products and Services offered by Caribbean Academy.
ARTICLE 2 – Product and Service Orders
Article 2.1 – The Services
2.1.1 – Description of Services
The Client must be of legal age at the time of placing the Service order.
By ordering the Services, the Client certifies that they have ensured that they are not subject to any contraindication for practicing sports, particularly the activities offered by Caribbean Academy, namely pole dance, acrobatic dance, gymnastics, dance and flexibility/contortion, and burlesque striptease.
Caribbean Academy offers different types of Services, including:
- Regular group classes on a time-spent or subscription basis (pole dance, exotic dance, flexibility, circuit training, aerial, etc.);
- Private lessons;
- Bachelorette party animation services;
- Shows, team-building sessions, workshops, or company classes;
- Room rental services;
- Photo shooting services;
- Professional training/internship services;
- Intensive dance “camps.”
2.1.2 – Service Modalities
a) Regular classes:
Classes can be purchased directly at Caribbean Academy or on the website: www.caribbean-academy.fr
Regular classes, which last one (1) hour or one and a half hours (1h30), are defined according to a schedule established by Caribbean Academy.
Regular classes can be purchased in different formats with limited validity:
- They can be paid for by the Client individually and are valid for one (1) month from the date of purchase.
- The Client can also purchase 5, 10, or 20 class cards valid for three (3), six (6), or twelve (12) months respectively from the date of purchase, with payment facilities available. The cards are personal and non-transferable.
Subscriptions offered by Caribbean Academy commit the client for a period of 6 months. Their validity is counted from the first class. Subscriptions are personal and non-transferable.
Since the number of places in each class is limited, it is advised that the Client reserves their classes either on the website or at Caribbean Academy.
Reservations can be canceled without charge up to 24 hours in advance. The class fee will be due, and no refund will be made in case of cancellation beyond this period or if the Client does not show up for the class.
The same applies to Clients with an unlimited PASS, who will be liable for the value of the booked class if not canceled within the specified time or if they do not show up. Without payment, the Client will not be able to access the next class.
In case of pregnancy, injury, or professional relocation for 3 weeks or more, the Client – exclusively benefiting from a 1-year unlimited PASS – can request to suspend their account for the concerned period. Temporary suspension will be granted by Caribbean Academy upon presentation of proof within a maximum of 7 days from the date the proof takes effect.
b) Private classes:
The Client can also purchase private 1.5-hour classes, payable individually and valid for six (6) months from the date of purchase.
Reservations can be canceled without charge up to 24 hours in advance. The class fee will be due, and no refund will be made in case of cancellation beyond this period or if the Client does not show up for the class. Classes cannot be rescheduled if the Client is late.
c) Caribbean Camp:
“Camps” include twelve (12) hours of workshops and various activities that may change depending on the number of participants or adverse weather conditions.
In case of reservation via our site www.caribbean-academy.fr, the camp fee will be due, and no refund will be made in case of cancellation or if the Client does not show up. Classes cannot be rescheduled if the Client is late.
The price of our stays includes sports activities, accommodation, breakfast essentials, a brunch at the end of the stay (Sunday morning at the villa), and animations, as well as a photo shoot on a beach chosen according to weather conditions. They are not contractual and are confirmed upon registration. They may be subject to eventual modifications applicable to all registered or intending participants. Promotions and discounts are neither cumulative nor retroactive and are purely personal.
Accommodation includes a double room with a double bed to share with another participant.
Car rental is not included in the Caribbean Camp offer. Participants need to organize among themselves. The driver will be responsible for the rental and the related deposit. They must also hold a valid driving license with over 3 years of experience.
d) Other Services:
Other services will be implemented based on a quote prepared by Caribbean Academy according to the Client’s request characteristics.
For bachelorette and bachelor parties, these Services are offered under certain conditions: a minimum of 2 participants is required, and the Client must pay a booking deposit. The Client can cancel their reservation up to 5 days before the event. If not canceled within this period, the deposit will be retained by Caribbean Academy.
The Client can rent the room at an hourly rate defined by Caribbean Academy. The Client can cancel their reservation up to 7 days before the event. Otherwise, Caribbean Academy will retain 50% of the amount paid by the Client in case of cancellation up to the day before the Service and the entire amount in case of cancellation on the same day.
For other Services, payment must be made upon reservation, and no refund or exchange will be made by Caribbean Academy in case of cancellation or non-performance of the Service due to the Client.
Caribbean Academy does not provide refunds for cancellations or absences at “Caribbean Camps,” even for medical reasons or injuries. The client agrees to familiarize themselves and comply with the entry rules of Guadeloupe (97 French Antilles) if they need to travel there. Each participant is responsible for obtaining necessary information from the concerned authorities and ensuring their documents comply with the chosen stay requirements (especially for non-EU nationals). The steps and costs of obtaining these documents are the participant’s responsibility. Additionally, in case of non-compliance, the resulting consequences (refusal at the border for lack of visa or other required document) and all incurred costs remain the participant’s responsibility.
Caribbean Academy does not provide transport services between your residence and the studio (plane, bus, or car) and even for camp services and activities listed in its schedule. The flight is therefore not included in the “Caribbean Camp” service.
ARTICLE 3 – Access Conditions to Services
Access to classes is conditional on compliance with the following rules:
The client must arrive 10 minutes before the class start time. For safety reasons due to the necessity of participating in the warm-up session, the Client cannot join the class if they arrive more than 10 minutes late; Cards, PASSES, and camps are personal and cannot be transferred to a third party; The class start time will not be postponed in case of the Client’s delay for any reason; The Client must adhere to Caribbean Academy’s internal regulations, reproduced in Article 4 below, under penalty of expulsion from the class without refund.
ARTICLE 4 – Internal Regulations
- Shoes worn outside cannot be worn within the studio
- The studio is not accessible to minors, whether as participants or accompanied spectators (parental authorization is required from 16 years old).
- The studio and all its spaces are non-smoking
- Jewelry and piercings are not allowed during classes to ensure safety
- Access to the class will be denied for more than 10 minutes of delay. The class fee remains due, and no refund will be made.
- Only participating students are allowed during classes; spectators are not permitted in the class areas.
- The Client commits to not engaging in any dangerous behavior for themselves or others
- The Client agrees not to attempt movements or figures not previously requested by the instructor
- The Client certifies having civil liability insurance
- The Client takes care of the equipment provided and does not encourage the degradation of equipment or premises
- Access to the studio is strictly forbidden to anyone under the influence of alcohol, drugs, or dangerous medications
- Animals are not allowed in the studio
- The Client certifies having no medical contraindications for sports practice
- Caribbean Academy reserves the right to expel anyone not complying with the internal regulations or endangering others without compensation or refund
ARTICLE 5 – Prices and Terms of Payment
5.1 Price
The prices of the Services and Products are those indicated on the website or provided via a quote prepared by Caribbean Academy. They are in euros and include all taxes (VAT).
Caribbean Academy reserves the right to modify its prices at any time, but the Services and Products will be billed based on the rates in force at the time of the Client’s order.
5.2 Payment
The payment is due immediately upon order or booking. The Client can pay by credit card, PayPal, or bank transfer.
The Client agrees to provide accurate payment information and has the right to use the provided payment method.
In case of payment default, Caribbean Academy reserves the right to suspend the Client’s access to the booked Services and Products until full payment is made.
ARTICLE 6 – Withdrawal and Cancellation
The Client has a right of withdrawal of fourteen (14) days from the conclusion of the Service contract or the Product order, in accordance with the French Consumer Code.
To exercise this right, the Client must inform Caribbean Academy of their decision to withdraw by sending an email to contact@caribbean-academy.fr before the expiry of the withdrawal period.
However, if the Client expressly requests the performance of a Service before the end of the withdrawal period, they waive their right of withdrawal for that Service.
In case of cancellation after the withdrawal period or in cases specified in Articles 2.1.2 and 5.2, no refund will be made, and the full amount will remain due.
ARTICLE 7 – Liability
Caribbean Academy commits to providing Services in accordance with the description on its website or provided quotes. However, Caribbean Academy cannot be held liable for any non-performance or improper performance of all or part of the contracted Services attributable either to the Client or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure.
ARTICLE 8 – Intellectual Property
All content on the website www.caribbean-academy.fr (texts, images, videos, logos, etc.) is the exclusive property of Caribbean Academy. Any reproduction or use of this content without prior written authorization is strictly prohibited.
ARTICLE 9 – Personal Data Protection
Caribbean Academy collects and processes personal data in accordance with the French Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR). The Client has the right to access, rectify, and oppose their personal data at any time by sending an email to contact@caribbean-academy.fr.
ARTICLE 10 – Applicable Law and Dispute Resolution
These General Conditions are governed by French law. In the event of a dispute, the Client agrees to first attempt an amicable resolution with Caribbean Academy. If no agreement is reached, the dispute will be brought before the competent French courts.
By accepting these General Terms and Conditions of Sale and Service Provision, the Client acknowledges having read and understood all its terms and accepts them without reservation.
